Terms of Service - Talarius

These Terms of Service ("Terms") govern your access to and use of Talarius services. By using our services, you agree to be bound by these Terms.

1. Description of Service

Talarius provides a prepaid alerting service that enables you to send notifications to messaging platforms including Telegram, Discord, and Slack. The service includes:

Alert delivery API
Heartbeat monitoring
Dashboard for managing projects and viewing delivery history
Credit-based billing with no recurring subscriptions

2. Account Registration

To use Talarius, you must:

Provide accurate and complete registration information
Be at least 16 years of age
Keep your account credentials secure
Notify us immediately of any unauthorized access

You are responsible for all activity that occurs under your account.

3. Credits and Payment

Purchasing Credits

Credits are purchased as one-time transactions. There are no recurring subscriptions. All prices are in USD unless otherwise stated.

Credit Expiration

Purchased credits expire 12 months after purchase. Trial credits expire 30 days after account creation. Expired credits cannot be refunded or restored.

Refunds

Credits are non-refundable except where required by law. If you experience technical issues preventing credit usage, contact support within 30 days.

4. Acceptable Use

You agree not to use Talarius to:

Send spam, unsolicited messages, or bulk commercial messages
Harass, threaten, or abuse others
Distribute malware, phishing content, or illegal material
Impersonate others or misrepresent your affiliation
Violate any applicable laws or regulations
Interfere with or disrupt the service or servers
Attempt to gain unauthorized access to systems or accounts
Resell or redistribute the service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

5. API Usage

Your use of the Talarius API is subject to:

Rate limits: 100 requests per minute (account-wide), 1 delivery per minute (per project)
Message size: Maximum 1024 bytes per message
Buffer limits: Maximum 100 messages queued per project

API keys must be kept confidential. You are responsible for all API calls made using your keys.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

Perform scheduled maintenance with reasonable notice
Experience downtime due to circumstances beyond our control
Modify, suspend, or discontinue features with notice

Delivery to third-party platforms (Telegram, Discord, Slack) depends on their availability and is not guaranteed.

7. Intellectual Property

The Talarius service, including its design, logos, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.

You retain ownership of the content you send through our service. By using our service, you grant us a limited license to process and transmit your content as necessary to provide the service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICE FAILURES (TELEGRAM, DISCORD, SLACK)

9. Indemnification

You agree to indemnify and hold harmless Talarius from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

10. Termination

You may close your account at any time through the dashboard. We may suspend or terminate your account if you:

Violate these Terms
Engage in fraudulent or illegal activity
Fail to pay applicable fees

Upon termination, your right to use the service ceases immediately. Unused credits are forfeited.

11. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
